Studio28 Productions agrees to sign over all rights associated with the ownership and use of materials originated by Studio28 Productions to the customer upon receipt of final payment for said materials. Until that time Studio28 Productions holds and reserves all rights to any content created by Studio28 Productions as set forth by the Copyright Laws of the United States of America (Title 17 U.S.C., et seq., and the Digital Millennium Copyright Act).
Once Studio28 Productions receives full payment, all rights to the final product, full and unrestricted, will be released to the customer for use in all media, in all markets, for unlimited period of time.
Studio 28 Productions retains and reserves the rights to use any and all content developed by Studio28 Productions, regardless of ownership, for display and self-promotional purposes.

Upon receiving your completed order form, Studio28 Productions will secure a down payment in an amount equal to 50% of the total price of your order, which will cover certain expenses some of them are:
- Order processing;
- Creation and development time;
Intellectual and proprietary materials utilized in developmental stages.
The initial fee in non-refundable and does not include final rights for ownership and usage. All rights will be signed over to you upon receipt of your final payment and approval of the product.
If the project framework was enlarged during the initial order fulfillment time, Studio28 Productions may secure intermediary payments in amount agreed with the customer, but not exceeding one half of the additional cost. The intermediary fees are non-refundable and do not include final usage rights, which will be released upon receipt of final payment.
After customer's approval of the final design and receiving the final payment Studio28 Productions will release rights to the completed product, full and unrestricted. You will have a right to use the final product in all media, in all markets, for unlimited period of time.
Customer has a right to terminate the project at any time. There won't be any extra fees in this case. The customer holds no rights to the designed materials. Studio28 Productions retains full ownership of all work that was done for the project. Initial designs will be presented within 7-10 business days following the receipt of your order and down payment, depending on the service ordered.

Any changes and revisions are made within 8-10 business days, depending on the kind of service. Completed and approved variant of the website design will be delivered by electronic means in 1 business day after the receipt of the final payment.

Studio28 Productions provides no guarantee of copyright to customer. Customer assumes responsibility of obtaining Trademark or Copyright of any material created by Studio28 Productions. Studio28 Productions assumes no liability in the event that customer is unable to obtain Trademark or Copyright of said material for any reason.

Payments – Inconsistencies On The Timing And The Method Of Payments Can Lead To Production Delays. The Solution Would Be To Negotiate A Systematic Manner For Payments. Timely Submission Of Invoices Relative To Payments For Procurements Of Materials, Funds To Offset Purchases And Local Invoice Payments.
Differences Of Opinions In Development Of Ideas – Creative Differences In Advertising Concepts, Unrealistic Deadlines, And Inadequate Funding Can Lead To Glitches In The Production Process, Local Price Increase Due To Economic And Political Instability. A Solution To This Problem Would Be For Us To Compromise On These Issues And To Encourage Regular Communication To Ensure Both Parties Are On Par.
Design Or Manufacturing Costs Exceeding Budget Projections – Costs Increase Due To Change In Suppliers (Costs And Quantities) Also Demand And Supply Of Certain Production Materials May Change The Production Costs Of Certain Materials.
Untimely Deliveries From Suppliers – Issues Concerning Customers, Flight And In-Transit Delays, And Lost Or Stolen Merchandise Would Lead To Production Delays.
Public Acceptance And Opinion – Personal Misconceptions, And Stereotypes Surrounding These Advertisements And Activities Will Not Allow Total Market Penetration With The Messages. This Problem Can Be Countered By Producing Advertisements That Are All Inclusive, In That It Targets Every Group And Transcends Certain Barriers And Misconceptions.
Unforeseen Circumstances – Sickness, Political Violence, Technical His-Haps (Server Failures, Hard-Drive Crashes) Power Outages Or Power Surges, Will Delay The Production Process And Affect The Timeline Of Activities. Backup Equipment And Alternative Locations Will Be Used To Complete The Tasks. Generators And Backup Systems (UPS) Are In Place On The Premises To Offset And Of These Mishaps.
Breakdown In Communication- Failure To Liaise With The Appropriate Personnel On Both Sides Can Lead To Inconsistencies In The Production. We Have Appointed Mr. Raule Williams As The Liaison Person, Who Will Be In Charge Of Communicating With The Appropriate City Mall Management Personnel Who Will Be Made Known To Us At An Appropriate Date. |
